SUMMARY
Kevin J. Healy is a trial attorney in the firm’s San Diego office. He represents business entities, public agencies, and individuals in civil litigation matters arising out of a variety of claims, including professional liability, construction claims, environmental, product liability, personal injury, and employment. In addition, Mr. Healy provides outside general counsel, contract drafting and negotiation, risk management, and business advisement services to his clients. Mr. Healy has led presentations to industry groups and published articles on the subjects of professional liability, risk management, and the Americans with Disabilities Act.
Mr. Healy holds an AV Preeminent Rating from Martindale Hubbell and has been selected as a Top Lawyer in San Diego by San Diego Magazine since 2013. He is a member of the American Council of Engineering Consultants, American Society of Civil Engineers San Diego, and The American Institute of Architects San Diego and Palomar.
Mr. Healy graduated cum laude from California Western School of Law in San Diego, California where he was a member of the Law Review. Previously, he attended Brandeis University in Waltham, Massachusetts where he obtained a Bachelor of Arts in Sociology and was elected to the Brandeis University Athletics Hall of Fame.
EXPERIENCE
Complete Defense Verdict for Civil Engineer: Mr. Healy represented a civil engineer that was sued for negligently performing a boundary survey that resulted in the loss of property by a non-client. Mr. Healy successfully tried this matter and received a complete defense verdict for his client.
Complete Defense Verdict for Industrial Hygienist: Mr. Healy represented an industrial hygienist that was sued for negligently investigating a construction site for hydrocarbons that led to chemical exposure resulting in death. Mr. Healy successfully tried this matter on behalf of his client and received a complete defense verdict.
Demurrer Granted Without Leave to Amend for Mechanical
Engineer: Mr. Healy represented a Mechanical Engineer that was sued by a non-client residential real estate developer for negligently designing a mechanical and plumbing system resulting in construction defect claims brought by a Homeowner Association. Mr. Healy filed a demurrer to the cross-complaint, which was granted without leave to amend, disposing of the entire action.
Successfully Negotiated a Dismissal on Behalf of Architect Client: Mr. Healy represented an architect in a suit brought by a commercial real estate developer that claimed negligent design services resulted in cracks to concrete slabs. Mr. Healy was able to successfully negotiate a dismissal in exchange for a waiver of fees and costs.
Defense Verdict for City: Mr. Healy represented a city that was sued by a group of plaintiffs claiming that leaking city water lines caused a landslide that resulted in the loss of seven homes. Mr. Healy tried the matter and received a complete defense verdict.
Successful Motion for Summary Judgment for Tavern Owner:
Mr. Healy represented a tavern owner that was sued by a plaintiff for personal injuries sustained from a fight that occurred outside of the tavern. Mr. Healy successfully disposed of the action through a motion for summary judgment based on a lack of foreseeability of harm argument.
Favorable Settlement for Attorney Client: Mr. Healy represented an attorney accused of mishandling an underlying litigation leading to an adverse verdict. Mr. Healy successfully struck the plaintiff’s prayer for punitive damages and then negotiated a settlement on terms favorable to his client.
Verdict for Commercial Building Owner: Mr. Healy prosecuted a successful action on behalf of a commercial building owner in an action where his client’s former tenant refused contractor’s access to the unit to clean up the building after extensive flooding. The refusal caused the commercial building owner to pay for remediation of mold that would not have occurred had a proper clean-up been conducted. Mr. Healy received a verdict in favor of his client after trial.
