Ryan E. Palumbo

SUMMARY

Ryan E. Palumbo is a trial attorney in the firm’s Orange County office, assisting clients throughout the State of California in both litigation and transactional matters. Mr. Palumbo’s legal practice is focused on the representation of professionals including architects, engineers, lawyers, landscape architects, financial advisers, insurance and real estate agents. On behalf of design professionals, Mr. Palumbo has handled a wide variety of disputes involving both public and private projects including educational facilities, hospitals, highway infrastructure, mixed-use and multi-family residential developments. Mr. Palumbo has successfully handled numerous cases involving catastrophic personal injury and wrongful death. In addition to representing clients in litigation, Mr. Palumbo regularly counsels clients on risk mitigation strategies and assists with contract negotiation and employment issues.

Mr. Palumbo received his undergraduate degree from the University of Vermont and his Juris Doctor from Chapman University, Dale E. Fowler School of Law. He is admitted to all of the federal district courts in the state. Mr. Palumbo is an active participant and lecturer to local chapters of the AIA, ACEC, PLUS, and other professional organizations.

EXPERIENCE

Summary Judgment Granted for Architect in Design Defect Suit: Plaintiff claimed the design of a hospital emergency room was deficient and directly caused personal injuries when he was dropped off at the hospital in duress and was unable to find assistance. Motion for summary judgment granted based upon the “completed and accepted doctrine.”

Summary Judgment Granted for Geotechnical Engineer in Constitutional Rights Suit: Geotechnical engineer served as surface mining expert for a governmental agency tasked with conducting yearly evaluation of mining operations. Plaintiff mine owners sued the government entity and client claiming constitutional rights violations with a demand of $100 million. Motion for summary judgment granted in favor of our client.

Anti-SLAPP Motion Granted in Malpractice Suit: Attorney was sued for malpractice, discrimination and violation of local eviction ordinances following the prosecution of an unlawful detainer action. Special Motion to Strike (Anti-SLAPP) was granted in favor of our client.

Dismissal Secured for Insurance Agent Following Motion for Summary Judgment: Plaintiff claimed that his insurance agent failed to provide adequate homeowner’s insurance coverage following a burglary which resulted in the loss of uninsured valuable personal property. Dismissal secured following filing of motion for summary judgment.

Dismissal Secured on Behalf of Youth Golf Tournament Organization: Plaintiff was severely injured during a youth golf tournament by a golf cart driven by a local resident. Dismissal of claims was secured following mediation.

Demurrer Granted in Favor of Architect Against Homeowners: Residential homeowners alleged that a roof was inadequately supported causing sagging and deflection. Demurrer granted based upon the statute of limitations.

Anti-SLAPP Motion Granted in Favor of Attorney in Debt Collection Matter: Attorney was sued for violations of the federal and state fair debt collection practices acts, including claims of negligence, malicious prosecution, abuse of process, and fraud, during collection efforts on behalf of a homeowner’s association. Case was resolved in favor of attorney when a special motion to strike (Anti-SLAPP) was granted.
