SUMMARY
Kristopher P. Lancial is a trial attorney at the firm’s San Diego office, litigating cases throughout California. Mr. Lancial has defended a wide range of disputes, including injury defense, corporate and public entity liability, professional liability, construction defect, breach of contract, and business litigation. As part of his civil litigation practice Mr. Lancial has represented individuals, corporations, public entities, design professionals, transportation companies, landowners/managers, their employees, and more in cases involving automobile, construction, job site, and other general premises incidents that often involving complex multi-party matters with catastrophic injury or death claims. He has successfully argued various motions including demurrers and motions for summary judgment resulting in complete dismissal of his client prior to trial.
Besides serving as defense counsel in these type of cases, Mr. Lancial also provides consulting services in relation to various contracts and licensing agreements. He has experience with various intellectual property fields including copyright, trademark, and patents.
Mr. Lancial successfully uses strategies to position cases for favorable results in trials, arbitrations, and mediations. In recent cases his strategies have led to voluntary dismissals of his clients, fee shifting via tender and acceptance of defense, granted dispositive motions, as well as resolution of matters through both formal mediation and direct negotiation all of which have saved clients thousands in litigation expenses.
