Tyler B. Thompson

SUMMARY

Tyler B. Thompson is a trial attorney in the firm’s San Diego office. Mr. Thompson practices in the areas of professional liability, public entity liability, construction law, employment law, maritime law, general liability, and general business litigation. Mr. Thompson’s practice has an emphasis on the defense of design professionals including architects and engineers, as well as the defense of counties, cities, sheriffs, police officers, and other public employees. While in law school, Mr. Thompson was a member of the school’s National Trial Team and a member of the San Diego Journal of Climate and Energy Law. Mr. Thompson also held two internships with the United States District Court for the Southern District of California in the chambers of the Honorable Judge Gonzalo P. Curiel and the Honorable Bernard G. Skomal.

EXPERIENCE

Anti-SLAPP Motion Granted for Attorneys and Law Firm: Mr. Thompson represented two attorneys and their law firm for alleged malicious prosecution following the dismissal of an underlying dispute between siblings to quiet title to their mother’s properties. Plaintiff alleged the underlying dispute was brought without probable cause because clients knew it was barred by res judicata. Mr. Thompson successfully argued a special motion to strike the plaintiff’s complaint (Anti-SLAPP) which was able to dispose of the entire matter at the early stage of litigation and recoup attorneys’ fees and costs for his clients.

Successfully Negotiated a Dismissal on Behalf of Design Professional: Mr. Thompson represented a civil engineer that was sued by a developer for alleged design issues that were outside of the engineer’s scope of work and for portions of the engineer’s design that had been re-designed by a subsequent engineer. Mr. Thompson was able to obtain a dismissal with prejudice through aggressive discovery and negotiation tactics.

Motion for Summary Judgment Granted for Sheriff and County: Mr. Thompson represented a sheriff and a county for the alleged violation of constitutional rights. Mr. Thompson successfully argued a motion for summary judgment and was able to dispose of the entire matter.

Favorable Settlement for Architect Client: Mr. Thompson represented an architect sued by a general contractor alleging improper details that led to the failure of a ground water retention basin. Mr. Thompson was able to successfully negotiate a positive settlement of all claims.

Demurrer Sustained in Favor of Design Professional: Mr. Thompson represented a design professional in response to a myriad of contract and tort based allegations. Mr. Thompson demurred to all causes of action. After several rounds of briefing and lengthy oral argument on complicated contract, indemnity, and negligence based claims, Mr. Thompson was able to convince the judge to sustain the demurrer and dismiss all claims against his design professional client. Through post-ruling negotiations, Mr. Thompson was able to obtain a waiver of the claimant’s right to appeal, bringing full and complete closure to all claims against his client.

Demurrer Sustained in Favor of General Contractor: Mr. Thompson represented a general contractor facing personal injury claims of a sub-contractor’s employee who was injured on the job. Mr. Thompson argued that pursuant to the seminal case of Privette v. Superior Court and Labor Code section 3602, Plaintiff’s recovery was limited to workers’ compensation. The judge agreed with Mr. Thompson and dismissed the entirety of Plaintiff’s claims.

Complaint Dismissed Against Insurance Broker: Mr. Thompson represented an insurance broker in response to allegations that the broker breached its professional duty to secure the proper coverage for the Plaintiff. After some limited discovery and strong negotiation, Mr. Thompson obtained full and complete dismissal of all claims against his client.
